These terms govern your use of Evertx (the "Website"), operated by Config44, LLC., a Pennsylvania limited liability company ("we", "us"). By using the Website, you agree to them. If you don't agree, please don't use the Website.

1. What the Website is

The Website is a free, read-only viewer for public data on the Everscale blockchain, provided for informational purposes only. It doesn't hold funds, provide wallets, or create, sign or send transactions. We can't reverse, cancel or recover transactions, freeze funds, or tell you who controls an address.

The Website isn't affiliated with, endorsed by or sponsored by Everscale or any organization behind it. "Everscale" and other names belong to their owners and are used here only to describe the data shown.

2. Data accuracy

The data on the Website comes from third-party blockchain nodes that we don't control, and it may be delayed, incomplete or wrong. The Website also converts and formats that data, such as addresses, amounts and times, and that processing may contain errors too.

Don't rely on the Website alone to confirm that a payment or transaction happened: verify important information independently before you act on it. Before sending funds to an address, always check it in your wallet, in the format your wallet expects.

3. No advice

Nothing on the Website is financial, investment, legal or tax advice, or a recommendation to buy, sell or hold any asset.

4. Third-party content

Blockchain data, including message contents and files you download from the Website (such as .boc files), is created by third parties. We don't review or endorse it, and it may be inaccurate, offensive or harmful. You use it at your own risk.

5. Acceptable use

You agree not to:

• use the Website for anything unlawful;
• overload or disrupt the Website, including with excessive automated requests;
• try to gain unauthorized access to the Website or the systems behind it, or to get around its security measures or rate limits.

We may limit or block anyone's access to the Website at any time.

6. Intellectual property

The Website's software, design and text are owned by Config44, LLC. or its licensors, except where an open-source license says otherwise. We claim no ownership of blockchain data.

7. Changes to the Website

We may change, suspend or discontinue the Website, or any part of it, at any time without notice.

8. Disclaimer of warranties

THE WEBSITE AND ALL DATA ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY, ANY WARRANTY THAT THE WEBSITE WILL BE AVAILABLE, UNINTERRUPTED OR ERROR-FREE, AND ANY WARRANTY THAT THE WEBSITE OR ANY FILES DOWNLOADED FROM IT ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CONFIG44, LLC. AND ITS MEMBERS, MANAGERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF FUNDS, DIGITAL ASSETS, PROFITS OR DATA, ARISING FROM OR RELATED TO YOUR USE OF, INABILITY TO USE, OR RELIANCE ON THE WEBSITE OR ANY DATA OR FILES OBTAINED THROUGH IT, WHETHER BASED ON CONTRACT, TORT (INCLUDING OUR OWN NEGLIGENCE), STRICT LIABILITY OR ANY OTHER LEGAL THEORY, EVEN IF WE WERE TOLD SUCH DAMAGES WERE POSSIBLE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE WEBSITE, UNDER ANY LEGAL THEORY (INCLUDING OUR OWN NEGLIGENCE), WILL NOT EXCEED US $100.

Nothing in these terms limits any liability or right that can't be limited under applicable law.

10. Indemnification

You agree to indemnify and hold harmless Config44, LLC. and its members, managers, employees and agents from any claims, losses and expenses, including reasonable attorneys' fees, arising from your misuse of the Website or your breach of these terms.

11. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute related to the Website or these terms will be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction and venue of those courts.

Any claim related to the Website or these terms must be filed within one year after it arises. Otherwise, it is permanently barred.

12. Changes to these terms

We may update these terms from time to time. Because the Website has no accounts, we can't notify you directly. Instead, we'll post the updated terms on this page and change the "Last updated" date above, so please check back periodically. If a change is significant, we'll also note it on the Website for a reasonable period.

Updated terms take effect when posted and apply to your use of the Website from then on. By continuing to use the Website after that, you accept them. Changes won't apply to disputes that arose before they were posted.

13. General

These terms are the entire agreement between you and us about the Website. Our Privacy Policy explains how we handle information, but it isn't part of these terms. If anything else on the Website, such as the summary in the footer, conflicts with these terms, these terms control.

If any provision is found unenforceable, the rest remains in effect. If we don't enforce a provision, that isn't a waiver of it. We may assign these terms, for example to a successor business.
